Terms of Service

These Terms of Service ("Terms") govern your use of mouktar.com and the client portal, marketplace and invoicing tools provided through it (the "Service"), operated by Mouktar ("we", "our", "us"). By creating an account or using the Service, you agree to these Terms.

1. Your Account

  • You must give accurate information and keep it up to date.
  • You are responsible for keeping your credentials confidential and for all activity that happens under your account.
  • You must be at least 18 years old, or have authority to accept these Terms on behalf of the company you represent.
  • We may suspend or close accounts used for abuse, fraud or unlawful activity.

2. What We Provide

  • A client portal to submit proposals and track projects and deliverable files.
  • A digital asset marketplace, with both free and paid products.
  • Project management and invoicing tools, including online payment of invoices.

We may add, change or retire features, and we may take the Service offline for maintenance.

3. Digital Assets

  • Free assets — may be downloaded and used at no cost, under the licence rules below.
  • Paid assets — are purchased through Polar, our payment processor.

A purchase grants you a licence to use the asset in your own work, your company's work and your client projects. You may not redistribute, resell, sublicense, share or republish any asset, in whole or in part, as a product of your own.

4. Proposals and Projects

Submitting a proposal does not create a contract and does not guarantee acceptance. We may accept, reject or negotiate any proposal. If a project is accepted, the engagement is governed by the scope, price and timeline we agree in writing and by any invoice issued through the Service.

5. Payments and Invoices

  • All payments are processed by Polar. Prices are listed in US dollars (USD).
  • Invoices raised through the portal are payable by the due date shown on them.
  • Because digital products are delivered instantly, refunds are granted only where the law requires them or at our discretion.
  • Late or unpaid invoices may pause work on the related project.

6. Acceptable Use

You agree not to:

  • use the Service for unlawful purposes or in a way that infringes anyone's rights;
  • attempt to gain unauthorised access to any part of the Service, or probe, scan or bypass its security;
  • scrape, copy or bulk-download content, files or data from the Service;
  • resell the Service or provide it to third parties, or share your account with others.

7. Intellectual Property

The Service, including its design, code and content, and all digital assets, remain our property or that of our licensors. You receive no ownership rights, only the limited licence described in these Terms. Ownership of deliverables created for a client project is set out in the agreement for that project.

8. Availability and Liability

The Service is provided "as is" and "as available". We do not guarantee uninterrupted or error-free operation, and we are not liable for indirect or consequential losses, or for loss of profit, data or goodwill. To the extent permitted by law, our total liability is limited to the amount you paid us in the twelve months before the claim.

9. Termination

You may delete your account at any time from the Settings page. We may suspend or end your access if you breach these Terms. Clauses that by their nature survive termination (intellectual property, liability and governing law) continue to apply.

10. Changes to These Terms

We may update these Terms. The revision date at the top of this page shows the current version, and continuing to use the Service after an update means you accept it.
